ghorton91 Posted November 7, 2014 Share Posted November 7, 2014 Hey everyone, I am about to place my very first machine. I'm very excited about that and to start into all of this. I've found ONE topic on legality in Texas, and I need some clarification if anyone is from the state. I understand that there is no sales tax involved on items under 0.50 cents, so that's easy. However, I wasn't sure what else I need to do. I can go ahead and get a DBA registered with a business namebut do I need to do anything else? Are these bulk candy machines still considered "amusement machines"? Any advice would help, I would like to be completely legal. Mainly just trying to figure out if need to file business taxes at all, and if can become tax exempt for purchases. Texas Comptroller is who you need to go through. Whether or not you are going to be required to pay sales tax, you will need to apply and receive a sales tax permit before you begin earning. You will also be required to report your earnings even if no sales taxes are due. The Texas Comptrollers office has been very helpful in all of my dealings with them over the years. Bucking the stereotype surrounding gov't employees, comptroller reps have been patient, knowledgeable, and helpful. I hope your experience is the same. They can address your tax-exempt questions as well as any questions you have regarding your sales tax responsibilities. Here's their website. Call them so that they can walk you through the process and answer any of your question. I am not an expert and anything I know about the process I learned from them. Go directly to the source. TexasFreemason Posted March 24, 2015 Share Posted March 24, 2015 Bulk vending is NOT considered an amusement device. If you are 50 cents or below, you are completely exempt from sales tax. If you are a corporation or LLC you will have to file franchise tax, but it is simple unless you owe money, which is unlikely in bulk vending unless you have an obscene amount of machines.
