Yesterday while servicing I found she walked off with one of my uturns. Business owner thought it was ok since she was there on the initial placement and a part of the company. Assured them they did nothing wrong and filed police report. Police interview her and she claimed to be a part owner in the company and machine was hers, police are asking for some proof of ownership of the machine. Bought the machine used. Rick Posted October 16, 2013 Share Posted October 16, 2013 Oh boy. Do you have a sole proprietorship or LLC filed in your state? If so, it would be easier to prove she is NOT part-owner of the company (therefore the machine is not hers). Otherwise, I'm afraid you might be out of luck. Another option is if you have a receipt or record of a PayPal transaction proving you paid her for locating services that might be another workaround. Then you could pose the question to the police, "If she is a part-owner, then why would I have paid her for locating?" You're in a tough spot there. sherlock Posted October 16, 2013 Share Posted October 16, 2013 A lot of how you can prove she is not part-owner is dependent upon your business set-up. If there are business formation documents, bank accounts, business loans, business credit cards, tax records, or any other document that would show you as the sole owner or at least show that she is not involved in ownership of your vending company, then you have something you might be able to use. If you don't have a structured business the matter gets a little harder to settle. But just think...there must be a lot you can show as proof of ownership in your vending company. Some other possibilities: business cards with your name, charity contracts for stickers, accounts with suppliers, etc These secondary items are not legal documents, but the fact you have them and she has nothing that shows her as co-owner would lend weight to your argument. At first I thought the same thing, just a UTurn, but I think it's more of the concept that she can just get away with it. I simply wouldn't have the balls to, not only take the machine but then when questioned by police potentially dig myself even deeper into a hole by lying to them. Especially regarding something that's so easily proven like, "Oh yeah, well ya see I'm a part owner of that company". Which leaves us with a bigger question to ponder - what else would she do? She's either straight up stupid, a criminal, or both. In my 40 years on this earth, I've learned there are times it's best to cut your losses and this sounds like one of those times. Did she give you a reason that she took it. That is why I have my company name and phone number on every machine I have out, its also inside the machine also. I hope you have contacted your other locations to explain what is going on. Another question is in your first quote you stated the key was not available to show that it was yours. She was a lazy locator, a former friend who I was trying to help out with cash, and only landed apx 10 accts. I ran those accounts today and all were intact except for one location who put my machine in the back room because she told them I had no charity connections. My NCCS ID and my new roll of stickers ended that arguement. So hopefully the losses will stop. She knows of no other locations. I'm just forming the LLC so the theft predates the formation, might not be much help at the moment but they were interested to know that she hasn't taken action in civil court, which is where I would start if I had a partner screw me. I didn't continue with them, they got into some bad financial trouble from what I'm told. My guess is that they realized where they could get some 'easy cash'. Didn't pay full price.
