dapreachaman Posted April 6, 2009 Posted April 6, 2009 had one of my accounts sued in another community kid choked on a gumball, so i had to remove my machines. placed them both today. One in a sports cut (super cuts place with espn on all the flat screens) and one in a trucking center. see how they do in a couple of weeks.

sprint54fan Posted April 7, 2009 Posted April 7, 2009 Choked on a gumball..lawsuit.. I wonder if that was staged or not due to this economy and people are so sue happy now its not even funny.. I have a quick lube oil place on my route...a few months ago a lady called me (got my number on back of the machine) saying her 2 year old choked on a gumball.. she threatened me and I gave her my lawyers name and number..and neither I nor him has heard anything from the crazy lady! But on the other hand..2 questions come to rise.. 1) Where was she at when her 2 YEAR OLD..put a gumball in their mouth? and 2) WHO GIVES A 2 YEAR OLD A GUMBALL! I never lost the location and I told the manager what happened and he asked the same thing..who gives a 2 year old a gumball? Im glad it didnt turn out to be anything ..and I hope to never run into a lawsuit from stupid sue happy parent..
sterling Posted April 7, 2009 Posted April 7, 2009 Ok I have to point out something here. If the lawsuit required the company to remove all the machines. Then the presedent has been set. Now should all candy/gumball machines be removed from every business in America to protect the children from the dangers we offer. IMHO the compnay wimped out by allowing this kind of demand. I know they just wanted this to go away, but this couldt doom a lot of business for us in the future.
Quarter Master Posted April 7, 2009 Posted April 7, 2009 Talking about the gumball to the 2 year old.What I have done even on the gumballs is put a sticker right on the display that states "not recommended for children under 3 years old."I left the "choking hazard" part out.I also agree on "who gives a 2 year old a big gumball ?"
BluePlate Posted April 7, 2009 Posted April 7, 2009 I always what constitutes "choking". I once saw a kid gasp on a jawbreaker. His Dad gave him a swift wack and all was OK. I had a tire store tell me to get a machine out because of a "choking". I think some of these are urban legends. This is an easy way out for a District Manager to get his or her point across. Next time I hear this, I'm asking for specifics:D
dapreachaman Posted April 8, 2009 Author Posted April 8, 2009 these two locations for me weren't all that great, just average at best, so i didn't mind too much, but having to relocate was the bummer. I think the two new locations should be much better. We'll see when i check them in a couple weeks. the choking thing i think is a convenient excuse as well. I have also been told recently that pepsi told them they had an exclusive deal and everyone else had to leave. sounds more like a dm wanted people out.
